Terms and Conditions for Idealista Services

These Terms and Conditions apply to clients assigned by Idealista – Sociedade Unipessoal Lda. (Company B, VAT: 513131434) to LEANDRO GUERREIRO PHOTOGRAPHY (Company A, VAT: 515362174) for the provision of multimedia services (photography, virtual tours, professional video, and 3D), contracted by real estate agencies and other clients (Client C).

By accepting these terms, you help ensure high-quality, safe, and efficient service delivery.

1. Service Requests

All services must be booked exclusively through our online platform:

Availability by district and location, as well as the terms described here, must be respected at the time of booking.

2. Cancellations and Changes

  • Up to 24 hours before the appointment: Cancellations or changes may be made without penalty.
  • Same-day cancellations: Appointments canceled on the same business day will be considered completed services and charged accordingly.

3. On-site Accompaniment

All services must be accompanied by the designated real estate consultant or a representative identified in the request form.

4. Consultant Responsibilities

  • The property must be properly prepared for image capture.
  • Hygiene and safety conditions must be met inside and outside the property.
  • Current public health regulations (e.g., COVID-19) must be followed.
  • No one should move through the property during the service, if inhabited.
  • Pets must be safely confined or secured.

5. Mandatory Property Information

Before the appointment, the Client must inform us:

  • If the property has functioning artificial lighting.
  • Which rooms or areas should not be photographed.
  • Whether exterior areas should or should not be included.

6. Service Refusal or Interruption

If the conditions described above are not met, Company A reserves the right to refuse or interrupt the service. In such cases, the service will still be considered completed and invoiced.

7. Equipment and Damage

  • Company A is responsible for protecting and operating all professional equipment used on-site.
  • Any damage caused by Company A will be repaired or replaced at our expense.
  • If damage is caused by third parties (people, pets, or objects on the property), Client C will be held responsible for repair or replacement costs.

8. Property Care

We commit to leaving the property in the same condition it was found. Any damage directly caused by the image professional will be covered by us. Damage caused by third parties remains their responsibility.

9. Theft and Loss

Company A is not liable for any theft or loss occurring during the service. In the event of a suspected theft or loss, the relevant authorities must be notified immediately on-site.

10. Confidentiality

All information related to Idealista or its clients is confidential. This duty continues after the termination of services. Unauthorized disclosure may result in immediate termination and liability for damages.

11. Intellectual Property

All photos, videos, and multimedia material produced within the scope of these services are the exclusive property of Idealista. Company A waives any copyright or ownership claims over such material.

12. Use of Matterport

Company A, as an authorized user, may access the Matterport Cloud system provided by Idealista. Terms of use of Matterport apply (Matterport Terms of Service). Matterport services must be contracted exclusively through Idealista.

13. Data Protection (GDPR)

LEANDRO GUERREIRO PHOTOGRAPHY ensures that all personal data is processed in compliance with the European Union General Data Protection Regulation (GDPR):

  • Personal data will be used exclusively for service-related purposes.
  • Clients may request access, correction, or deletion of their data at any time.
  • Any data breach will be reported to Idealista and, if necessary, to the authorities within 24 hours.

14. Deadlines

All services must be delivered within a maximum of 5 business days after the appointment, unless otherwise agreed.

16. Governing Law and Jurisdiction

These Terms are governed by Portuguese law. Any dispute will be settled in the civil courts of Povoa de Varzim, Portugal.
